These Terms of Use ("Terms") govern your access to and use of the Your Debt Advocate website at yourdebtadvocate.com and any services accessed through it (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Your Debt Advocate is a consumer education resource that provides general information about consumer debt resolution options and connects consumers with senior debt specialists through the Free Debt Relief Assessment.
Your Debt Advocate is not a law firm, not a debt collector, not a credit repair organization, and not a financial advisor. We do not provide legal, financial, tax, or investment advice. For specific situations, consult qualified professionals in those fields.
By using the Service, you confirm that:
The articles, comparisons, FAQ entries, and other written content on the Service are provided for general consumer education only. The content is not legal advice, financial advice, tax advice, or investment advice. Reliance on the content for any specific situation is at your own risk. For specific advice, consult a qualified attorney, financial advisor, or tax professional.
While we make reasonable efforts to keep content accurate and current, laws, regulations, and industry practices change. We make no representation that any specific information on the Service is current, complete, or applicable to any individual reader's situation.
The Free Debt Relief Assessment is a service that connects consumers with senior debt specialists for an initial consultation about their debt situation. The assessment itself is free of charge to the consumer. The assessment does not create any obligation on the consumer to enroll in any debt resolution program.
Senior debt specialist services connected through the Free Debt Relief Assessment are provided by our fulfillment partner, Modern Financial Partners LLC. The terms and conditions of any debt resolution program enrolled in through Modern Financial Partners LLC are governed separately by the agreement between the consumer and Modern Financial Partners LLC.
The Free Debt Relief Assessment and connected senior specialist services are not available in Idaho, Oregon, or North Dakota. Consumers in these states may use the educational content on the Service but cannot be enrolled through the partner network.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:
The Service and all content on it (text, graphics, logos, images, audio, video, the "Sal" mascot character, software, and the compilation thereof) is owned by Your Debt Advocate or its licensors and is protected by U.S. and international intellectual property laws.
You may view and access the content for your personal, non-commercial use. You may share links to articles via standard social sharing tools. Any other use — reproduction, modification, distribution, derivative works, public display, or commercial use — requires our prior written permission.
The Service may include links to third-party websites or reference third-party services. We do not control those third parties and are not responsible for their content, policies, or practices. Your use of any third-party site or service is at your own risk and subject to that third party's terms.
Use of the Service does NOT create:
The Service is a consumer education resource. Specific advice for your situation requires a qualified professional in the relevant field.
The Service is provided "as is" and "as available" without warranties of any kind.
To the fullest extent permitted by law, we disclaim all express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and uninterrupted access. We do not warrant that the Service will be error-free, secure, or continuously available, or that defects will be corrected.
To the fullest extent permitted by applicable law, Your Debt Advocate, its owners, officers, employees, contractors, and affiliates shall NOT be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising out of these Terms or your use of the Service shall not exceed the amount you have paid us in the past 12 months — which is generally zero, since the Service and the Free Debt Relief Assessment are provided to you at no cost.
You agree to indemnify, defend, and hold harmless Your Debt Advocate, its owners, officers, employees, contractors, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising out of:
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of laws principles. Any dispute arising out of these Terms or your use of the Service shall be brought exclusively in the state or federal courts located in Albemarle County, Virginia, and you consent to personal jurisdiction in those courts.
Before filing any formal legal claim against us, you agree to first contact us in writing at the mailing address below and attempt in good faith to resolve the dispute informally for at least 30 days. We commit to the same good-faith effort.
If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable.
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. No waiver shall be effective unless in writing and signed by an authorized representative.
These Terms, together with the Privacy Policy and Disclaimers, constitute the entire agreement between you and Your Debt Advocate concerning the Service and supersede any prior or contemporaneous communications regarding the Service.
We may update these Terms periodically. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Service after updates constitutes acceptance of the revised Terms.
We reserve the right to suspend or terminate your access to the Service at our discretion, without notice, for conduct that we believe violates these Terms or is harmful to the Service, other users, or us.
